WHAT IS PROJSOLAR?
Services. ProjSOLAR is a platform that offers the following services: Assistance in the Execution of Photovoltaic Projects.
Caveats. By using PROJSOLAR, you acknowledge that the user is fully responsible for the designs created and shares the information on quantities of solar panels and inverters or micro-inverters for sending information by email and telephone.
Suspension. We reserve the right to suspend or cancel, at any time, your access to the application in case of suspicion of fraud, illegally obtaining a benefit or advantage, or for failing to comply with any conditions set out in these Terms of Use, in the Policy. Privacy Policy or applicable law. In such cases, no compensation will be due to you, and ProjSOLAR will be able to promote the competent action of return, if necessary, as well as take any other necessary measures to pursue and protect your interests.
HOW DO I ACCESS PROJSOLAR?

Our rights. All rights related to ProjSOLAR and its functionalities are the exclusive property of ProjSOLAR, including with regard to its texts, images, layouts, software, codes, databases, graphics, articles, photographs and other content produced directly or indirectly by ProjSOLAR (“ProjSOLAR Content”). ProjSOLAR Content is protected by copyright and intellectual property law. It is prohibited to use, copy, reproduce, modify, translate, publish, transmit, distribute, perform, upload, display, license, sell or otherwise exploit and reverse engineer the ProjSOLAR Content, for any purpose, without prior express consent. of PROjSOLAR. Any unauthorized use of the ProjSOLAR Content will be considered a violation of ProjSOLAR’s copyright and intellectual property.
INTELLECTUAL PROPERTY OVER SOFTWARE AND MATERIALS AVAILABLE
Intellectual property. For us at ProjSOLAR, the quality of the materials made available to the user is of paramount importance. Their creation is the result of a lot of work and dedication of our developers. Therefore, we reaffirm that ProjSOLAR guarantees that all right, title and interest (including, but not limited to, copyright, trademark and other intellectual property rights) in the service provided by us will remain with ProjSOLAR.
Non-acquisition of Rights. The user will not acquire any ownership rights over the services and contents of ProjSOLAR, except when expressly granted in these Terms of Use.
Downloading Content. It is prohibited for the user to download our content with the intention of storing it in a database to offer it to a third party other than the user himself. The content made available by us is also prohibited from being used to create a database or a service that may compete in any way with our business.
CLAIMS ABOUT COPYRIGHT INFRINGEMENT

Responsibility for Use. You are solely responsible for the use of ProjSOLAR and shall comply with the rules of these Terms of Use, as well as the legislation applicable to ProjSOLAR.
Liability for Any Damages. ProjSOLAR, its parent company, its affiliates, partners or employees will not, under any circumstances, be liable for direct or indirect damages that result from, or are related to access, use or inability to access or use ProjSOLAR.
Non-Accountability. IN VIEW OF THE CHARACTERISTICS INHERENT IN THE INTERNET ENVIRONMENT, PROJSOLAR IS NOT RESPONSIBLE FOR INTERRUPTIONS OR SUSPENSIONS OF CONNECTION, INCOMPLETE OR FAILING COMPUTER TRANSMISSIONS, OR TECHNICAL FAILURE OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, MALFUNCTIONING ELECTRONIC FROM ANY NETWORK, HARDWARE OR SOFTWARE. THE UNAVAILABILITY OF ACCESS TO THE INTERNET OR TO PROJSOLAR, AS WELL AS ANY INACCURATE OR INCOMPLETE INFORMATION ABOUT PROJSOLAR AND ANY HUMAN, TECHNICAL OR OTHER DEFECT IN PROCESSING PROJSOLAR INFORMATION SHALL NOT BE CONSIDERED PROJSOLAR’S LIABILITY. PROJSOLAR DISCLAIMS ANY LIABILITY ARISING OUT OF SUCH FACTS AND/OR ACTS.
Loss of Profits. Where permitted by law, ProjSOLAR and suppliers or distributors will not be liable for lost profits, lost revenue, lost data, financial losses or for indirect, special, consequential, exemplary or punitive damages.
Maintenance. It is your responsibility to keep your device environment (computer, cell phone, tablet, among others) safe, using available tools, such as antivirus, firewall, among others, in order to contribute to the prevention of electronic risks.
External Links. It is possible that ProjSOLAR may contain links to third-party websites and applications, as well as have integrated technologies. This does not imply in any way that ProjSOLAR endorses, verifies, guarantees or has any connection with the owners of these websites or applications and is not responsible for their content, accuracy, policies, practices or opinions. ProjSOLAR recommends that you read the terms of use and privacy policies of each third-party website or service that the user visits or uses.
Disclaimer. When ProjSOLAR facilitates your interaction with independent third-party providers, such as designers and designers, it does not mean that ProjSOLAR endorses, verifies, guarantees, has any links to or recommends such third parties.

HOW DOES PROJSOLAR HANDLE THE CONTENT YOU AND OTHER USERS PRODUCE?
Content Creation. ProjSOLAR may, in its sole discretion, allow you or any other user to submit, upload, publish or otherwise make available, in the application, text, image, audio or video content or information (“User Content”).
Prohibited Contents. Any User Content of a defamatory, libelous, libelous, violent, pornographic, obscene, offensive or illicit nature is prohibited, as determined by ProjSOLAR in its sole discretion, including proprietary information belonging to other people or companies (eg. , trademarks), without the express authorization of the holder of these rights, the violation of which will not be the responsibility of ProjSOLAR.
Content Ownership. Any User Content provided by you remains your property. However, by providing it to ProjSOLAR, you grant us a worldwide, indefinite, free, transferable license with the right to sublicense, use, copy, modify, create derivative works from, distribute, publish, display such Content of User in all possible formats and distribution channels, without further notice to you, and without the need for any payment, as long as this is related to the functioning of the platform. In addition, we will only have access to the amounts of panels and inverters or microinverters as well as user contacts, having no other access to any data of the person of the Susuary’s Customers.
Deletion of Content. ProjSOLAR may, but is not obligated to, review, monitor and remove User Content, in ProjSOLAR’s sole discretion, at any time and for any reason, without notice to you.
WHAT ELSE DO I NEED TO KNOW ABOUT THESE TERMS OF USE?
Changes. To improve your experience, ProjSOLAR is always being updated. For this reason, these Terms of Use may be amended at any time to reflect the adjustments made. However, whenever any modification occurs, you will be informed in advance by the email address provided by you at the time of registration or by a prominent notice in the application. If you do not agree with the new Terms of Use, you may reject them, but unfortunately this means that you will no longer be able to access and use ProjSOLAR. If in any way you use ProjSOLAR even after these Terms of Use have been changed, this means that you agree to all changes.
Conflict between Provisions. In the event of a conflict between these terms and the modifying terms, the later terms will prevail with respect to that conflict.
Law and Forum. These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any doubts and situations not provided for in these Terms of Use will first be resolved by ProjSOLAR and, if they persist, must be resolved by the Foro da Comarca de Hortolândia, São Paulo, to the exclusion of any other, however privileged it may be or will be.
